1. Introduction and Acceptance of Terms

These Terms of Service govern your use of the malagorent.com website and the car rental services offered through it in Малага, Andalusia, Spain. By accessing this website, submitting a booking enquiry, or completing a reservation, you confirm that you have read, understood, and agree to be bound by these terms in full.

These terms constitute a legally binding agreement between you (the renter) and Malagorent.com. If you do not agree with any part of these terms, you must not use our services. We reserve the right to update these terms at any time. Continued use of our site following any changes constitutes your acceptance of the revised terms. The date of the most recent revision is shown at the bottom of this page.

Our services are designed to make renting a car in Малага as straightforward as possible, including no deposit and no credit card booking options. These terms exist to protect both renters and our service standards across all vehicle categories we offer.

2. Eligibility Requirements for Car Rental in Малага

To rent a vehicle through malagorent.com, you must meet the following eligibility criteria at the time of pickup at your chosen location, whether that is Малага-Costa del Sol Airport (AGP), our city center desk near Calle Larios, the port area, or a hotel delivery address in Малага.

Minimum Age Requirements

The minimum age to rent a standard vehicle is 21 years old. Drivers aged 21 to 24 are classified as young drivers and may be subject to an additional daily surcharge, which will be displayed transparently at the time of booking. For premium vehicle categories - including convertibles, luxury saloons, and large SUVs - the minimum age requirement is 25 years old. Maximum driver age limits may apply with certain vehicle suppliers; please confirm at the time of booking if you are aged 75 or above.

Driving Licence Requirements

All renters must hold a full, valid driving licence that has been held for a minimum of one year prior to the rental start date. Drivers holding an EU or EEA driving licence may present their national licence without additional documentation. Drivers from the United Kingdom, United States, Canada, Australia, and other non-EEA countries are strongly advised to carry a valid International Driving Permit (IDP) alongside their national licence to ensure a smooth pickup process and compliance with Spanish traffic regulations. Provisional licences, learner permits, and any licence not written in the Latin alphabet without an accompanying certified translation will not be accepted.

Additional Drivers

Additional drivers must be present at the pickup desk, meet all the same eligibility criteria as the primary renter, and be registered on the rental agreement before driving the vehicle. An additional driver fee applies per person per day and will be confirmed at booking. Any unregistered driver operating the vehicle will void the rental agreement and insurance coverage immediately.

3. Bookings, Confirmations, and Cancellation Policy

Reservations made through malagorent.com are subject to vehicle availability at the time of booking. A booking is only confirmed when you receive a written confirmation by email from us. Please check all details in your confirmation carefully, including pickup location, vehicle category, rental dates, and any pre-selected extras such as GPS, child seats, or additional driver coverage.

Free Cancellation Policy

Most bookings made through malagorent.com qualify for free cancellation up to 48 hours before the scheduled pickup time. Cancellations made within 48 hours of pickup may be subject to a one-day rental charge as a late cancellation fee. Cancellations made less than 6 hours before pickup time, or no-shows at the pickup desk without prior notice, will result in a no-show fee equivalent to the full first day's rental rate. These conditions will be clearly confirmed at the time of booking for your specific reservation.

Amendments to Bookings

Date changes, vehicle upgrades, and location amendments may be requested by contacting us at info@malagorent.com. Amendments are subject to availability and any applicable rate differences. We will always endeavour to accommodate reasonable changes with no administration fee for requests made more than 48 hours in advance.

No-Show Policy

If you do not collect your vehicle within two hours of the confirmed pickup time and have not contacted us to advise of a delay, the booking may be released and treated as a no-show. We recommend contacting us as soon as possible if your flight is delayed or your plans change, particularly for airport pickups at Малага AGP.

4. Pricing, Payment, and What Is Included

All prices displayed on malagorent.com are shown in Euros (EUR) unless otherwise stated. Prices are inclusive of Spanish VAT (IVA) at the applicable rate. The total rental cost confirmed at booking includes the base rental rate, mandatory insurance (CDW and third-party liability), and unlimited mileage unless otherwise specified. Local surcharges and taxes applicable in the Andalusia region are included in the displayed total.

No Deposit and No Credit Card Booking

One of the key features of renting through malagorent.com is our debit-card-friendly, no deposit booking process. You do not need to provide a credit card to confirm your reservation. At pickup, you will be required to present a valid debit or credit card in the main driver's name for identity verification purposes only. No large deposit hold will be placed on your card in connection with our standard booking terms. Please note that individual supplier terms at specific pickup locations may vary; any exceptions will be clearly communicated before you confirm your booking.

Optional Extras and Add-Ons

The following optional extras are available to add at checkout or at the pickup desk, subject to availability:

• Satellite navigation / GPS unit - priced per day
• Baby seat (group 0 or group 1) - priced per day
• Booster seat (group 2 or group 3) - priced per day
• Additional driver registration - priced per driver per day
• Full coverage upgrade (zero excess) - priced per day
• Roadside assistance enhancement - priced per rental

Prices for extras are displayed at the time of booking selection and are subject to change. Pre-booked extras are recommended for popular items, particularly child seats during peak summer periods in Малага.

Fuel Policy

Unless otherwise stated at the time of booking, vehicles are supplied with a full tank of fuel and must be returned with a full tank. If the vehicle is returned with less fuel than at pickup, a refuelling fee will be charged comprising the cost of the missing fuel plus a service charge. Pre-paid fuel options may be available on selected vehicles and will be shown at checkout. We strongly recommend returning the vehicle fuelled at a petrol station near the Малага airport terminal, the port, or along the N-340 coastal road before returning to any of our pickup locations.

5. Permitted Vehicle Use and Prohibited Activities

All vehicles rented through malagorent.com must be operated in accordance with Spanish traffic law and the specific conditions of the rental agreement. Vehicles may only be driven on public roads within Spain unless an explicit cross-border agreement has been confirmed in writing prior to departure. If you intend to drive from Малага into Gibraltar, Portugal, Morocco (via ferry), or any other territory, you must notify us in advance and obtain written authorisation.

Prohibited Uses

The following uses are strictly prohibited and will void your rental agreement and any insurance coverage immediately:

• Off-road driving, including unsealed tracks, beach driving, or agricultural land access roads
• Use in any form of motor racing, speed testing, or competitive driving event
• Subletting, re-hiring, or loaning the vehicle to any person not registered on the rental agreement
• Operating the vehicle under the influence of alcohol, drugs, or any substance that impairs driving ability
• Using the vehicle to transport goods or persons for commercial hire or reward
• Towing, pushing, or carrying loads that exceed the manufacturer's stated capacity
• Smoking inside the vehicle - a deep-cleaning fee will be charged if evidence of smoking is found
• Transporting animals without prior written consent and appropriate protective covers in place
• Driving outside the permitted territory without prior written authorisation

Breach of any of the above conditions will render the renter fully liable for any resulting damage, loss, penalties, or legal costs, regardless of any insurance coverage included in the rental.

6. Insurance Coverage and Liability

All rentals include a basic level of insurance as standard, covering Collision Damage Waiver (CDW) and Theft Protection (TP) subject to an excess, as well as third-party liability cover in accordance with Spanish law and the minimum requirements set under European Union motor insurance directives applicable in Andalusia.

Standard Excess Amounts

The standard excess (the amount you would be liable to pay in the event of a claim) varies by vehicle category and will be clearly stated in your booking confirmation. Typical excess amounts range from EUR 500 for economy vehicles to EUR 2,000 or more for premium and luxury categories. The excess applies per incident, not per rental period.

Full Coverage Zero-Excess Upgrade

Renters may choose to upgrade to a full coverage policy, which reduces the excess to zero for most incident types. This upgrade is available at checkout and can also be added at the pickup desk, subject to availability. Full coverage typically includes CDW with zero excess, theft protection with zero excess, and glass and tyre protection. Specific terms of the zero-excess upgrade will be provided in your rental documentation at pickup.

Exclusions from Insurance Coverage

Insurance coverage, whether standard or upgraded, does not apply in cases of driver negligence, prohibited vehicle use as described in Section 5, driving under the influence, wilful damage, or use outside the permitted territory. In such cases, the renter is personally liable for all damage, repair costs, recovery costs, and any third-party claims arising from the incident.

Reporting Incidents

In the event of an accident, collision, theft, or damage to the vehicle, you must contact us immediately at info@malagorent.com and, where required by Spanish law, file a report with the Policia Nacional or Guardia Civil. Failure to report an incident before returning the vehicle may affect your ability to make a successful insurance claim.

7. Limitation of Liability

Malagorent.com operates as an intermediary platform connecting renters with vehicle suppliers in Малага and the wider Andalusia region. We take reasonable care to work with reputable suppliers who meet our service standards, but we cannot accept responsibility for actions, omissions, or service failures attributable directly to third-party vehicle suppliers or operators.

To the maximum extent permitted under applicable Spanish and EU consumer protection law, our total liability to you in connection with any booking or service failure shall not exceed the total amount paid by you for the specific rental to which the claim relates. We are not liable for indirect, consequential, or punitive losses, including but not limited to lost holiday enjoyment, missed flights, or business interruption losses, except where such losses arise from our own gross negligence or wilful misconduct.

We do not accept liability for delays or failures caused by circumstances beyond our reasonable control, including extreme weather events affecting the Малага region, industrial action, acts of government, or force majeure events.

8. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Spain. Any disputes arising from or in connection with these terms, a booking made through malagorent.com, or the provision of car rental services in Малага shall be subject to the exclusive jurisdiction of the courts of Малага, Andalusia, Spain, unless applicable EU consumer protection law requires otherwise.

EU residents have the right to pursue disputes through the European Commission's Online Dispute Resolution platform in addition to pursuing claims through the Spanish court system. Nothing in these terms limits your statutory rights as a consumer under applicable Spanish or EU law.
